These Terms and Conditions of Use (hereafter TCU) govern your access to and use of ErasmusIntern website and services, which are provided by Erasmus Student Network AISBL (hereafter ESN). Please read these TCU carefully, and contact us if you have any questions.
ESN reserves the right to modify or replace any of these TCU, or change, suspend, or discontinue the Service (including without limitation, the availability of any feature or content) at any time by posting a notice on the site.
If you continue to browse and use erasmusintern.org, you signify that you have read, understand and agree to be bound by these TCU. Therefore, any participation in this website will constitute full and irrevocable acceptance of the TCU. If you do not agree to abide by the above, please do not use this site.
The terms “us” or “we” or “our” refer to the owner of the website, ESN AISBL. The terms “you” or “your” refer to the User of the website.
Associates shall mean any natural person or legal entity that co-operate with ESN for the purposes of ErasmusIntern.
Cookie shall mean a file saved on the User’s computer, which records necessary information for the best function of the website. This file is sent by the Server to the browser used by the user at the time and is saved in their computer. Cookies have a predefined duration.
Professional User shall refer to companies, organisations, HEIs or other similar entities who are offering internships, seeking interns and/ or providing special offers to interns.
Third-party User shall refer to companies, organisations or other similar entities who are looking to offer internships and/or seeking interns for other than their own legal entities, for example for their customers and/or partners.
Server shall mean the required hardware and/or software for the programming, hosting and publishing of the platform.
Single User shall refer to students or persons in general who are looking for or browsing internships and internship opportunities.
Traineeship and/or Internship shall refer to the presentation or projection of an opportunity for training of the Professional User, as described by them on the website for the duration agreed.
User shall refer to both the single and professional user
Website, ErasmusIntern, site, media, platform, project shall refer to the webpage www.erasmusintern.org which is hosted, powered and maintained by ESN and will host, present, transmit and project the available internships.
2. Registered Owner
ErasmusIntern is owned and maintained by Erasmus Student Network AISBL, registered office address: Rue Joseph II / Jozef II-straat 120, 1000 Brussels, Belgium. Erasmus Student Network (ESN) is a non-profit international student organisation. Our mission is to represent international students, thus provide opportunities for cultural understanding and self-development under the principle of Students Helping Students.
3. Platform – Description of services
ErasmusIntern is a platform designed to match companies or other organisations offering internships to students and/or young persons seeking internships.
The ErasmusIntern platform is not designed to match Third-party Users looking to match their customers' and/or partners' available internships to students seeking internships. Any such activity is prohibited and the Owner has the right to at any moment deny, unpublish or exclude such content that does not comply with these Terms and Conditions.
4. Registration – Access to the website
You may browse ErasmusIntern and view content without registering, but as a condition to using certain aspects of the website, you are required to register with ErasmusIntern and warrant that you provide ErasmusIntern with accurate and truthful registration information (e-mail address and the password you will use to access the service). You have to keep your registration information accurate and up-to-date. You shall not:
- provide any false personal information to ErasmusIntern (including a false e-mail) or create any account for anyone other than yourself without such person's permission;
- use another person information with the intent to impersonate that person;
- use an ErasmusIntern account that is subject to any rights of a person other than you without appropriate authorization;
use an ErasmusIntern Professional User account to offer internships and/or seek interns for any other legal entity than your own;
By registering to ErasmusIntern you agree that you are at least 18 years old at the moment of registration.
5. Owner rights and obligations
ESN will take all due care and diligence and use best efforts to ensure that the material hosted and published on the Platform will be available exactly as provided by the Professional Users with no interruptions. ESN will take all due care in order to ensure that the website is in line with all terms and conditions hereby listed.
ESN may at its sole discretion deny the provision of services (hosting, or other) to the Users, in cases where the information does not comply with the terms and conditions, or when the content is unlawful, disrespectful, discriminating and/or against the principles of ESN and exchange programmes.
ESN warrants and represents that it will not accept internships that advertise, promote, produce, provide or link to adult content, promote or facilitate illegal activities including but not limited to Internet piracy.
6. Professional User rights and obligations
The Professional User and hereby grant to ESN a world-wide, non-exclusive free licence to reproduce and display on any media properties the internships or any other content provided (including all contents, trademarks and brand features contained therein) for the sole purpose of publishing on ErasmusIntern according to the present TCU and any other terms that might be agreed upon in a separate contract.
The Professional User must provide ESN with all the content material that is needed and has been agreed between them in due time and in accordance with the technical and other requirements and specifications of the Platform. The Professional User are in any case the sole responsible for the soundness if their creative material and actual content and in case this does not comply with the requested technical requirements or agreed terms, ESN has no obligation to provide and has the right to deny its Services.
The internships shall in no way contain anything that is or considered to be misleading, offensive, defamatory, false, unethical or obscene and it will not violate any third party’s intellectual property or other rights.
The Professional User shall not charge or require users on the platform or outside of it a direct or indirect financial or other type of fee in order to partake in the internships published on the ErasmusIntern platform. ESN has the right to unpublish and remove any content that breaches this requirement, as well as reject future access to the ErasmusIntern platform to any Professional User that do not comply with this requirement.
The Professional User warrant and represent that they are solely responsible for any legal liability arising out of or relating to the internships provided hosted and hereby agree to indemnify, defend and hold ESN harmless, as well as the Platform, the officers, directors, agents, publishers, affiliates and employees from and against all claims, actions, liabilities, losses, expenses, damages, and costs (including, without limitation, reasonable attorneys' fees) that may at any time be incurred by any of them by reason of any claims, suits or proceedings including but not limited to libel, defamation, violation of right of privacy or publicity, copyright infringement, trademark infringement or other infringement of any third party right, fraud, false advertising, misrepresentation, product liability or violation of any law, statute, ordinance, rule or regulation throughout the world in connection with the content of the internships, arising out of any material breach, representation or warranty under any agreement with ESN.
In cases where the Professional User cannot respect their obligations under these TCU and/or the separate agreements, due to force majeure, they must notify ESN for any such reason within 15 days from the date the act commenced. It is hereby acknowledged and agreed that any delays of the suppliers or any other third parties with whom the professional user co-operates for the purposes of ErasmusIntern, do not constitute force majeure.
The Professional User warrants and represents that
- They are the owner or are licensed to use the entire contents and subject matter
- The internships contained therein do not violate any law or regulation governing false or deceptive advertising, do not contain any misrepresentations or content that is defamatory or violates any rights of privacy or publicity, do not contain any child pornography or link to such content or link to software piracy or link to any form of illegal activity (i.e., how to build a bomb, hacking, etc) nor do they contain any gratuitous displays of violence, obscene or vulgar language, and abusive content or content which endorses or threatens physical harm, any content promoting any type of hate-mongering (i.e., racial, political, ethnic, religious, gender-based, sexuality-based or personal), do not and will not infringe any copyright, trademark, patent or other proprietary right, comply with all applicable law and regulations, Codes of Ethics and fair Practices applicable in the market.
- They will obtain all required licences to create such internships, and that they will only create internships for their own legal entities.
- They are the sole responsible for the contract and realization of the terms provided for, presented and hosted in the Platform.
- Explicitly guarantee that the internships do not violate any third party’s intellectual property and/or other rights.
- They have full legal power and authority to enter into this agreement and that they will comply with all applicable laws related to the provision of internships and/ or services online.
- They have read, comprehended, acknowledged and agreed with the present TCU as well as with the terms and conditions specified in any separate agreement with ESN.
7. Liability Policy – Limitation of Liability
This site and its content are offered for informational purposes only; ESN shall not be responsible or liable for the accuracy, usefulness or availability of any information made available via the site, and shall not be responsible or liable for any error or omissions in that information.
The information on our web pages is provided for convenience as part of the service we offer at this website. Every effort has been made to ensure the accuracy of the information contained in these pages. Neither we nor our staff will be responsible for any misleading, false or otherwise injurious information and advice communicated on the site or for any results obtained from the use of such information or advice. We will not be liable for any loss or damage suffered by user through the user’s reliance on any such content available on or through any such site or resource.
We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the website (especially regarding information in the profile and internship offers). You are solely responsible for the content you upload. We have the right to remove any material or posting you make on the Website if, in our opinion, such material does not comply with the content standards set out in our acceptable use policy.
We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to the Website constitutes a violation of their intellectual property rights, or of their right to privacy.
In no event will ESN be responsible in contract, tort, negligence or otherwise for loss of profits, business, contracts, revenues, goodwill, production and anticipating savings or any indirect, consequential, special or economic loss of any kind arising from any failure to publish or host in a timely manner or at all any internship or from any faults, omissions, technical problems and malfunctioning attributed to the Platform, Internet Service Providers or delays in the transmission or storage.
Without limiting the foregoing, ESN will have no liability for any failure or delay resulting from any governmental action fire, riot any other act of God or any other condition beyond the control of ESN affecting provision of services, production or delivery in any manner.
ESN does not give any guaranty in relation to a) the properness of the internships b) the legality of the internships hosted and the non-infringement of third party rights c) any viruses of fatal errors of the media systems.
We care about the security of our users. While we work to protect the security of your content and account, ErasmusIntern cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.
ErasmusIntern may contain links to third-party websites or other events or activities that are not owned or controlled by ErasmusIntern or ESN. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from ErasmusIntern, you do so at your own risk and you agree that we don’t have any liability arising from your use of or access to any third-party website, content or service.
8. Data Privacy Protection
ESN is particularly concerned about keeping user data secure and protected. ESN undertakes to comply with European Directives on the data protection.
Personal data is collected, saved, processed and used as part of the provision of services. User profiles, as well as user-uploaded application documents (e.g., cv, cover letter, resume, etc) are stored in our database. All such data is saved electronically.
The user is solely responsible for ensuring the confidentiality of his or her log in or access information (email address and password).
ESN does not pass on any personal individual data to third parties. An exception is, of course, the publication of the profile in which the user entered data for this purpose and the publication of which the user has agreed to by creating his profile. Also included in this exception is user-initiated forwarding of application documents to the contacted recruiter (receiving company/organisation).
The user can individually determine at any time if his/her profile is to be displayed in full or just specific parts. ESN is not responsible for the confidentiality of user data and application documents attached (e.g., cv, cover letter, resume) which users provide publicly or is sent to recruiters through the application process.
There is no automatic timeout for users logged in who have been inactive. You must log out at the end of each session.
General visitor data is registered on the website. This can notably include the IP-address of your computer, the possible username, the moment of retrieval and data sent by the browser of the User. This data is registered and used for statistical analyses of visit data and click-behaviour on the website. Additionally this data is used for optimization of the website. Such date shall be kept anonymous.
Incorporated in the Platform are buttons to promote or share web-pages on the social networks Facebook and Twitter, as well as Google Plus and LinkedIn. These buttons are realized by code supplied by Facebook and Twitter, as well as Google Plus and LinkedIn and not by ESN. This code places a cookie. Please read the respective privacy statements to see what they do with the personal data which is acquired and processed by this code.
You always have the option to view, alter or delete your personal data. In case such thing is not possible directly through the online Platform you can inform us in writing via e-mail at firstname.lastname@example.org and make your related request.
9. Intellectual property rights, Infringement of copyright and trademarks
All ErasmusIntern content (images, pictures and logos) is protected by copyright. Copying of our logos and/or any other third party logos, and content accessed via this website and publishing it elsewhere is not permitted without prior written approval from ESN or the relevant copyright owner. We also do not permit use of our logo as a link without prior permission.
Requests for permission to use our logo should be directed to email@example.com.
Only the user is responsible for the content determined and made available for publication by him in terms of infringement of press, competition rights and other rights. By registering, the user confirms that he has obtained licenses from the owners of copyright and other rights required or possesses all necessary rights for publication of the documents, information and data made available by him on the internet.
The Professional User assigns to ESN a non-exclusive world- wide license to reproduce and publish the whole or part of the internships for the purpose of the Platform and also assigns a non- exclusive world-wide license to reproduce and publish the whole or part of the internships for the purpose of ESN promotion of services.
ESN can and will use overall statistics of the internship without the prior written notice of the Professional User and for the purpose of marketing and promotion of ESN and ErasmusIntern. In cases where the Professional User does not agree with this policy, he has to notify that in writing to ESN.
The Professional User grants ESN a non-exclusive, royalty-free, worldwide right and license to use, reproduce, perform, display and distribute all internships and related information provided including any trademarks, service marks, logos or other source or business identifiers, during and after the term of each campaign to limited audiences for demonstration purposes only and also use each name, in a factual and non-disparaging manner, in lists produced for promotional or marketing purposes.
Change of terms and conditions:
- ESN reserves the right, at its sole discretion, to modify or replace any of these TCU.
- It is your responsibility to check these TCU periodically for changes. Your continued use of the ErasmusIntern following the posting of any changes to these TCU constitutes acceptance of those changes.
The failure to exercise any right or remedy under these TCU or enforce strict performance of any right shall not be deemed to be a waiver of that right, nor operate to bar the exercise or enforcement of it at any time or times thereafter. If any part of these TCU by any reason becomes invalid, illegal or unenforceable to any extent, this term will not affect any other provision of these TCU or any other agreement between the parties.
Applicable Law and jurisdiction
The parties shall in good faith resolve with an agreement any difference that might arise between them with regard to the services, using any technical, legal or other way they deem adequate.
You agree that in the event of any dispute of any nature that may arise between you and ErasmusIntern, these terms and conditions of use shall be governed by and construed exclusively in accordance with the law of Belgium. Each party hereby irrevocably submits to the jurisdiction of the Courts of Brussels. Any difference between the parties concerning the application, interpretation, invalidity of the TCU, the constitution or not of rights and obligations of the parties from the contract or from tort, is interpreted according to the Belgian Law and is under the sole jurisdiction of the Courts of Brussles, to which the parties are subject willingly.
